Sweepstakes Rules (the "Rules")

THE SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES AND CANADA (the "Eligible Region") ONLY. DO NOT ENTER THIS SWEEPSTAKES UNLESS YOU ARE A LEGAL RESIDENT OF, AND LOCATED IN, THE ELIGIBLE REGION AT THE TIME OF ENTRY.

THE SWEEPSTAKES ARE SUBJECT TO ALL FEDERAL, STATE, PROVINCIAL AND LOCAL/MUNICIPAL LAWS. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

SPONSOR/ADMINISTRATOR (UNITED STATES): For entrants from the United States, the 2012 Delo Bass Boat Sweepstakes (the "Sweepstakes") is offered and sponsored by Chevron Products Company (a division of Chevron U.S.A. Inc.) (the "U.S. Sponsor") and administered by Unified Resources, Inc. (the "U.S. Administrator"). The U.S. Sponsor is located at 6001 Bollinger Canyon Road, San Ramon, CA  94583. The Administrator is located at 10665 Richmond Ave. Suite 130, Houston, Texas 77042.

SPONSOR/ADMINISTRATOR (CANADA): For entrants from Canada, the Sweepstakes is offered and sponsored by Chevron Canada Limited (the "Canadian Sponsor") and administered by Marcom Group  (the "Canadian Administrator"). The Canadian Sponsor is located at  6975 Pacific Circle, Unit A Mississauga, ON L5T 2H3The Canadian Administrator is located at  1180 Courtneypark Drive, Mississauga, ON, L5T 1P2

The Sweepstakes is co-sponsored by the U.S. Sponsor and Canadian Sponsor (collectively the "Sponsors") and co-administered by the U.S. Administrator and Canadian Administrator (collectively the "Administrators").

TIMING AND DRAWING: The Sweepstakes begins on May 1, 2012, 12:01 AM Central Standard Time ("CST") and ends on September 30, 2012, at 11:59 PM CST (the "Sweepstakes Period"). A random drawing will be conducted at the sweepstakes administrator's office on or about October 5, 2012, in Houston, Texas, United States from among all eligible entries received from the Eligible Region. Administrator will draw for one (1) grand prize winner, (1) first prize winner, (4) second prize winners. The grand prize winner will be the first picked via a random draw from among all eligible entries received during the Sweepstakes Period. One (1) first prize winner will be the second picked via a random draw from among all eligible entries received during the Sweepstakes Period. One (1) second prize winner will be the third picked via a random draw from among all eligible entries received during the Sweepstakes Period. One (1) second prize winner will be the fourth picked via a random draw from among all eligible entries received during the Sweepstakes Period. One (1) second prize winner will be the fifth picked via a random draw from among all eligible entries received during the Sweepstakes Period. One (1) second prize winner will be the sixth picked via a random draw from among all eligible entries received during the Sweepstakes Period. Eligible entrants are only eligible to win one prize.

ELIGIBILITY: The Sweepstakes is open to legal residents of the Eligible Region who have reached the age of majority in their state, province or territory of residence at the time of commencement of the Sweepstakes Period. Employees (current and retired), suppliers, representatives and agents of the Sponsors, their affiliated companies, subsidiaries, advertising and promotional agencies and the immediate families and/or members of the households of any of the above are not eligible to enter the Sweepstakes or win a prize.

To enter online, during the Sweepstakes Period participants may enter the Sweepstakes by registering on-line at www.ChevronDelo.com. Follow the on-screen instructions and complete the registration form by providing all of the information requested. When the form is complete, click the "Submit" button to receive one (1) entry into the Sweepstakes. All on-line entries must be received no later than 11:59:59 PM CST on September 30, 2012.

Mail

To enter by mail, mail in your Full Name, Street Address, City, State, Zip/Postal Code, Date of Birth, Daytime Phone Number and E-mail Address to: "Delo® Bass Boat Sweepstakes", PO Box 421559 Houston, Texas, 77242-1559.   All mail-in entries must be received by October 1, 2012. The Sponsors are not responsible for mail entries that are lost, stolen, not received, destroyed, damaged, misdirected, illegible, incomplete, fraudulent, late, or postage due which will be disqualified.

To enter online, during the Sweepstakes Period participants may enter the Sweepstakes by registering on-line at www.ChevronDelo.com and click the Canadian entry process. Follow the on-screen instructions and complete the registration form by providing all of the information requested. When the form is complete, click the "Submit" button to receive one (1) entry into the Sweepstakes. All on-line entries must be received no later than 11:59:59 PM CST on September 30, 2012.

Mail

To enter by mail, mail in your Full Name, Street Address, City, State, Zip/Postal Code, Date of Birth, Daytime Phone Number and E-mail Address to: "Delo® Bass Boat Sweepstakes", 1180 Courtneypark Drive, Mississauga, ON, L5T 1P2 .   All mail-in entries must be received by October 1, 2012. The Sponsors are not responsible for mail entries that are lost, stolen, not received, destroyed, damaged, misdirected, illegible, incomplete, fraudulent, late, or postage due which will be disqualified.

Limit one (1) entry per person, per calendar month of the Sweepstakes Period (May, June, July, August, and September 2012) regardless of the method of entry. No photocopies or mechanical reproductions will be accepted. Entries generated by a script, macro or other automated means will be disqualified. Each entrant must be the rightful owner (or have authorized use) of the e-mail address identified in the entrant's online entry as of the date the online entry was submitted. In the event of a dispute as to the identity of a winner(s) - for online entries: The winner(s) will be deemed to be the person in whose name the e-mail account governing the e-mail address was opened. For mail-in entries: the winner(s) will be deemed to be the person whose name is registered to the phone number used to enter by text. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by entrants becomes the property of the Sponsors upon the submission of the entry.

CONDITIONS OF ENTRY: By entering, entrants agree to accept, abide by and acknowledge compliance with these Rules, including but not limited to all eligibility requirements and the decisions of the Sponsors. No correspondence will be entered into except with a potential winner. The decision of the Sponsors and their representatives in respect of any matter related to this Sweepstakes (either before or following selection) is final and without appeal.

FOR RESIDENTS OF QUÉBEC:Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

PRIZES:

Grand prize: One (1) grand prize is available to be won in the Eligible Region consisting only of the following:

• One (1) 2012 ZX190 Skeeter® bass boat with Pacific Blue option package, an outboard motor selected solely by the Sponsors, a trolling motor selected solely by the Sponsors, a trailer selected solely by the Sponsors and an accessory package (accessory package consists of items selected solely by the Sponsors); and
• Chevron lubricants products gift package consisting of items selected solely by the Sponsors (collectively the "Grand Prize"). 

Total approximate retail value (ARV) of the Grand Prize is USD$33,000.00.

Only the boat itself and other accessories as stated in the previous paragraph form the Grand Prize and without limiting the generality of this statement any taxes, all insurance, gasoline, on-going maintenance and boat registration/licensing, any other licensing, and any other costs, expenses, fees, etc. associated with owning and operating a bass boat are the sole responsibility of the Grand Prize winner. Grand Prize winner does not have a choice of colour of boat and cannot add any options including any optional equipment to the boat or upgrade. Grand Prize boat and other prize portions may not be as shown in any advertising associated with this Sweepstakes.

First prize: One (1) first prize is available to be won in the Eligible Region consisting of:

• An appearance on the "Honey Hole - Outdoors TV Show", with host and bass professional, Bill Wilcox;
• round trip economy air transportation for two (2) to the Dallas international airport from the gateway city closest to the winner's residence on an airline selected solely by the Sponsor (definition of gateway city shall be determined solely by the Sponsors);
• rental car allowance of USD$300.00 (rental of the car itself is the responsibility of the winner; if the winner chooses not to rent a car they may keep the car rental allowance);
• up to three (3) nights accommodation (based on double occupancy) in a hotel selected by the Sponsors;
• USD$1,500.00 spending money in the form of a gift card selected by the Sponsor (collectively the "First Prize").

Total approximate retail value (ARV) of the First Prize is USD$10,000.00.

The First Prize winner must accept the set visit date as finally scheduled by the Sponsors; if the winner is unable to attend the taping on the exact scheduled date and/or opts not to accept the set visit prize this portion of the First Prize will be forfeited and nothing will be awarded in its place but the winner will be permitted to collect the $1,500.00 spending money gift card portion of the First Prize. The First Prize winner (and guest if applicable) must properly sign applicable release forms which must be returned to and received by the Sponsors within 15 days of the release being sent to the winner otherwise the First Prize will be forfeited in its entirety and an alternate winner may be selected, at the sole discretion of the Sponsors.

Costs of everything not specifically stated above as included in the First Prize are the responsibility of the winner (and guest if applicable), and without limiting the generality of this statement the following costs are the responsibility of the winner: transportation from winner's residence to/from the gateway airport closest to their residence, health insurance, items of a personal nature, food, beverages, entertainment, valid travel documentation, passports, transfers to and from the airports, additional car rentals, medical/health expenses, gratuities, excess baggage fees, communication charges, and all personal expenses and incidentals. 

If winner is a resident of Canada, then winner and traveling companion must have valid passports and visas (with the term "valid" being defined as what is valid under Canadian, United States and/or any foreign laws) at the time of departure from Canada including up to the time of return to Canada as applicable and in the event for any reason the winner does not have a valid passport/visa at the time of departure neither the winner nor their traveling companion may travel and the First Prize will be forfeited in its entirety and nothing will be substituted in its place but if at the time of departure the winner does have a valid passport/visa and traveling companion does not have a valid passport/visa the winner may travel though the winner may not substitute a new traveling companion.

The First Prize winner's travel companion must execute a liability/publicity release in order to accompany the winner on the First Prize trip.  In the event that winner's travel companion is under the age of majority in his/her legal state or province of residence, the liability/publicity release must be executed by such minor's parent or legal guardian on their behalf. Liability/publicity release must be executed and returned prior to issuance of travel documents. Other travel restrictions, conditions and limitations may apply.

If the First Prize winner resides in the Dallas, Texas area (defined as being that air transportation is not available from their residence to Dallas due to their close proximity to Dallas) then transportation to the Houston area does not form part of the prize and nothing will be awarded to winner in its place and winner will be responsible at their own cost to arrive at the hotel selected as part of the First Prize package.

Second prize: Four (4) second prizes are available to be won in the Eligible Region, each consisting of:

• One(1) USD$500.00 gift card selected by the Sponsor (each a "Second Prize").

Total combined approximate retail value (ARV) of all Second Prizes: USD$2,000.00.

Odds of winning any prize depends on the number of eligible entries received. PLEASE NOTE: The ARV on prizing is based on US dollars and the ARV may vary between the US and Canada at time of being awarded and no difference will be given.

PRIZE REDEMPTION: A selected entrant will be notified by telephone via the number provided in their entry, and/or by registered mail sent to the address provided in their entry and will have 15 days from the date of the notification by registered mail to respond by following the instructions provided in such notification (the registered letter to the potential winner will be deemed to have been received after 5 days from the date of mailing). Upon receipt, the selected entrant must fill out and sign and return Sponsors' declaration and release form, confirming compliance with the Rules and releasing the Sponsors and their affiliates, and respective advertising and promotional agencies from all liability(for Canadian residents, response to such notification must include the correct answer to the mathematical skill-testing question which will be provided in the declaration and release without mechanical or other assistance). This form must be returned to the applicable Administrator's office within 15 business days of it having been sent. If the selected entrant cannot be contacted, fails to complete, sign and return the declaration and release form within the time frames stated in this paragraph, and also in the case of a winner from Canada does not correctly answer the mathematical skill-testing question, or if any such person otherwise fails to comply with these Rules, he or she will be disqualified and an alternate entrant may, at the sole discretion of the Sponsors, be selected in his or her place by randomly drawing from among all remaining entries generated during the Sweepstakes Period. The Sweepstakes Sponsors are not responsible for late, lost, stolen, delayed, illegible, incomplete, destroyed, misdirected or unsuccessful efforts to notify selected entrants. All prizes must be accepted as awarded in the name of the winner and may not be transferred or assigned prior to pick-up, or exchanged and has no cash surrender value in whole or in part. The Sponsors reserve the right to substitute any of the prizes or any portion thereof for a prize of at least equal value in the event of unavailability, or for any reason whatsoever. The Sponsors are not responsible if the prize is lost, stolen or mutilated and the prize will not be replaced. The value of the prize may be taxable as income; winners are responsible for any applicable taxes. All taxes, fees, duties and surcharges on the prize and/or the redemption thereof are the sole responsibility of the winner(s). Winners must agree to provide required personal information to the Sponsors in order to generate tax documents, if required. Each winner agrees to indemnify and hold harmless the Sponsors, their employees and agents from and against any liability for such taxes.

OTHER TERMS AND CONDITIONS: By entering the Sweepstakes, each entrant agrees that if they are a winner of any prize and they accept their prize the Sponsors may use his/her name, statements, likeness and/or photograph, in any and all media, and in any and all future advertising or publicity, without further consideration (without limiting the generality of the foregoing, the First Prize winner's release as well as their traveling companion's release will include all consents the Sponsors require for their appearance on the television show), except where prohibited. BY ACCEPTING A PRIZE, EACH WINNER AGREES THAT THE SPONSORS, THEIR SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL OF THE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS OF THE SPONSORS, THEIR SUBSIDIARIES AND AFFILIATES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY EACH WINNER FOR ANY LIABILITY, ANY INJURY, LOSS OR DAMAGES OF ANY KIND, TO WINNER OR OTHER PERSONS, INCLUDING (WITHOUT LIMITATION) INJURIES, LOSS OR DAMAGES ARISING OUT OF OR RELATING TO DEATH, INJURIES, DAMAGES OR LOSSES TO PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES - OR PRIZE-RELATED ACTIVITY.

MISCELLANEOUS: All entries become the sole property of the Sponsors and none will be returned. If, for any reason, the Sweepstakes cannot be run as planned, including due to tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of the Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, the Sponsors reserve the right in their sole discretion, to disqualify any person who tampers with the entry process, and (with the permission of the Régie des alcools, des courses et des jeux  in Quebec) to cancel, terminate, modify or suspend the Sweepstakes and if the Sponsors does so, to conduct some or all prize drawings from among all valid entries received to that point during the Sweepstakes Period through all methods of entering to the date of termination. The Sponsor will not be held to award more prizes than as set out in these Rules. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorized access to, or alteration of, entries. No communication or correspondence related to this Sweepstakes shall be exchanged with entrants except as provided for in these Rules or at the Sponsors' initiative. If a section of the Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law. For the purposes of these Rules, the entrant is the person whose name appears on the registration form and it is to this person to whom the prize will be awarded if he/she is selected and declared a winner.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO OBTAIN MORE THAN THE STATED NUMBER OF MAXIMUM ENTRIES OR DELIBERATELY DAMAGE ANY ENTRIES OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT, IN THEIR SOLE DISCRETION, TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW AND/OR CANCEL, TERMINATE, MODIFY OR SUSPEND THE SWEEPSTAKES.

ARBITRATION/CHOICE OF LAW:  Except where prohibited, participants in the Sweepstakes agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, or the administration of the Sweepstakes or the determination of a winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, to take place in the U.S.A. pursuant to the Rules of the American Arbitration Association, and where a matter affecting the interpretation of Canadian contest law applies the laws of Canada shall apply to that respective matter and also where the Régie des alcools, des courses et des jeux has jurisdiction that jurisdiction's laws shall apply with respect to that respective matter; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT SHALL ATTORNEYS' FEES BE AWARDED; AND (3) UNDER NO CIRCUMSTANCE WILL A PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of participant(s) and the Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Texas without regard to conflicts of law doctrine, except that where a matter affecting the interpretation of Canadian contest law applies the laws of Canada shall apply to that respective matter and also where the Régie des alcools, des courses et des jeux has jurisdiction that jurisdiction's laws shall apply with respect to that respective matter.

PRIVACY: By completing the entry form all entrants consent to the collection, use and distribution of their personal information by the Sweepstakes Sponsors solely for the purposes of: (i) running the Sweepstakes; (ii) as permitted by these rules (for example, pursuant to these rules, all entrants who accept a prize consent to the use of their personal information for publicity usages) including as permitted by any release signed; and (iii) if the entrants opts in (by checking the opt in box on the entry form) to the receipt of marketing information from the Sponsors about the Sponsors' products and services. Personal information is defined as anything that identifies an entrant as an individual, such as home telephone number, age, home address, email address, gender. The Sponsors may share entrant personal information with the Sponsors' affiliates, agents and representatives, solely for the purposes set out above.  Sponsors will not sell or transmit this information to any other third parties.  Personal information may be stored or processed in Canada or the United States, and may therefore be subject to the laws of those jurisdictions.
